Terms and Conditions (T&C) – Ansaam Incenses

1. Scope

These Terms and Conditions apply to all contracts concluded between Ansaam Incenses (hereinafter referred to as the “Seller”) and its customers (hereinafter referred to as the “Customer”) via the Seller’s online shop.

3. Offers and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By placing an order, the Customer submits a binding offer to purchase the selected goods. The Seller may accept this offer by sending an order confirmation via email or by dispatching the goods.


4. Prices and Payment Terms

All prices are final prices and include applicable statutory VAT.

Shipping costs are displayed separately during the checkout process.

Payment is due immediately upon conclusion of the contract. Available payment methods are shown during checkout and may include, but are not limited to:

  • Credit/Debit Card

  • PayPal

  • Klarna or other third-party providers

The Seller reserves the right to exclude certain payment methods in individual cases.


5. Delivery Conditions

Delivery is made to the address specified by the Customer.

Estimated delivery times are indicated on the website. Delays may occur due to circumstances beyond the Seller’s control.

If an item is unavailable, the Customer will be informed without undue delay.


6. Retention of Title

The goods remain the property of the Seller until full payment has been received.


7. Right of Withdrawal

Customers have a statutory right of withdrawal. Detailed information is provided in the separate Withdrawal Policy available on the website.


8. Returns and Refunds

Returns are subject to the Seller’s Return Policy. Refunds will be processed using the original payment method unless otherwise agreed.

The Customer bears the direct cost of returning goods unless otherwise stated.


9. Warranty and Liability

The statutory warranty rights apply.

The Seller shall be liable without limitation for damages resulting from:

  • Injury to life, body, or health

  • Intentional misconduct or gross negligence

In cases of slight negligence, the Seller shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable damages typical for the contract.

Any further liability is excluded to the extent permitted by law.


10. Limitation of Liability

To the extent permitted by applicable law, the Seller shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data.


11. Force Majeure

The Seller shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, war, strikes, supply chain disruptions, or governmental actions.


12. Data Protection

The Seller processes personal data in accordance with applicable data protection laws. Further details can be found in the Privacy Policy.


13. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the Customer is a merchant or legal entity under public law, the place of jurisdiction shall be Berlin, Germany.


14. Final Provisions

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
